Your listing has been removed: Trademark Violation

Post by johu »

I got a really sketchy email from ebay yesterday. It took me a while to figure out what it was about, at first I thought it was a scam.
So here is what I had done: I had put one of my Ni**an ;) drop in boards on ebay UK just to test perception. Two weeks ago I took it down again because it didn't really draw attention.
So here is the message I got:
Your listing or product was reviewed after receiving a report from the rights owner that it used their trademark without their permission. We urge you to contact the rights owner directly for more information about why they requested the review of your listing or product and whether you can sell the item.... The rights owner or an agent authorized to act on behalf of the rights owner, Nissan Motor Co., Inc., notified eBay that this listing violates intellectual property rights. When eBay receives a report of this type of violation, we remove the listing to comply with the law.We encourage you to contact Nissan Motor Co., Inc. directly if you have any questions.
So I'm surprised Nissan even found this listing. I wonder if the openinverter shop is threatened, too?

Nissan has been suing Mr. Uzi Nissan (the owner of http://www.nissan.com and http://www.nissan.net domains) since 1999 with trademark infringement claims. Apparently they like fiddling with individuals, despite being a multi billion company. I recommend you put some serious disclaimer telling that all the trademarks, product names etc. belong to their respective owners (Nissan, Tesla, etc.), and that should be enough. All in all, once their parts go to the aftermarket, they don't belong to those companies anymore and the owner can do whatever they like with the product. What we are doing here is nothing more than rooting/jailbreaking a mobile phone.

Heh, i would recommend you just change the name to "Nisan (only one s) leafs (possessive s) motor controller board" and check if there is a product under TM with that name. That should cover the webshop too. It is just a name, but they paid a lot to secure their hold of it.

Thanks for your comments. I did it like this now:
All product and company names are trademarks™ or registered® trademarks of their respective holders. Use of them does not imply any affiliation with or endorsement by them.

Leaf is a registered trademarks of Nissan Motor Co., Inc.
Nassin Fael would have been funny :)
